Abstract

The authors analyze the principle of discretion from the perspectives of both criminal law and administrative litigation law. The paper reflects on how the principle of discretion should be applied, based on the principles of good faith and equity. The authors aim to emphasize the importance of applying the principle of expediency in accordance with the principles of proportionality, good faith, and, last but not least, the fairness of the measure ordered.
