Résumé

Climate migration highlights a structural dysfunction of contemporary international law: its inability to respond to emerging forms of human vulnerability. In the absence of an explicit normative framework, people displaced by climate change remain outside traditional legal protection mechanisms. The article argues that this gap is not accidental, but the result of an outdated legal paradigm, focused on individual persecution and direct state responsibility. Through an in-depth doctrinal and jurisprudential analysis, the paper argues for the need to establish an autonomous legal status for climate migrants, proposing an integrated normative model, located at the intersection of refugee law, human rights law and environmental law.
